  1. Thank you for mentioning Guardian ad Litem. Every child who comes into the custody of DSS is appointed a GAL Attorney Advocate. Volunteers are also appointed and are trained individuals who provide a thorough and independent investigation, monitor court orders and to make sure the needs of the child are brought to the courts attendtion.

    • Ms. Frady, What warrants Counsel for Children’s Rights to enter on a custody case? Who do the Counsel for Children Rights account to when problems with the GAL arises? How many children/families do you think CFCR has destroyed? I know of many. One family or child destroyed is too many when there is an organization like CFCR supposedly looking out for the best interest of the child, and getting all those donations. Those donations should go to the school systems, and programs that do not fraud their communities.

      • I agree with the comments made by the NC court watch foundation. You should invite families that these three entities became involved with. Especially if their case has been on the docket for more than two years. There are judges that are biased to CFCR. The Cfamily court and CFCR need intervention.

      • DOES CFCR AUDIT, FOLLOW-UP WITH THE CASES? IS THERE ANOTHER PARTY THAT CAN INTERVENE ON THE CASES THAT HAS LINGERED FOR YEARS? WHO IS THE CFCR ACCOUNTABLE TO? ARE THE RECORDS OPEN TO THE PUBLIC? ARE YOU IN FACT SYSTEMICALLY REMOVING CHILDREN FROM A PROTECTIVE PARENT?
I HAVE SPOKEN TO AND REVIEWED DOCUMENTS OF SEVERAL PARENTS THAT CFCR HAS TRULY DESTROYED. THE FACTS ARE UNBELIEVABLE UNTIL ONE HAS SEEN AND HEARD IT FOR THEMSELVES. ONE NEEDS TO KNOW WHAT IS CFCR TRUE MOTIVE IN OUR COMMUNITY? CHILDREN AND FAMILIES ARE PAINFULLY OBVIOUS NOT THE TRUE MOTIVES. CHARLOTTE/ MECKLENBURG COUNTY NEED TO LOOK DEEPER INTO WHAT IS EVOLVING IN ITS COMMUNITY? THE VISION IS ULTIMATE CHAOS…

  2. The NC pediatric Society is working (with state DSS) on guidelines on children left alone.

    • I WAS JUST MADE AWARE OF A SITUATION WHERE A CHILD HAD BEEN LEFT ALONE DURING THE THIRD SHIFT HOURS. THE POLICE WAS CALLED, DSS WAS CONTACTED AND THIS CHILD HAS AN GAL/ADVOCATE. AFTER SPEAKING TO THE CHILD’S TEACHERS THE CHILD CONFESSED HE HAD BEEN TAKING CARE OF HIMSELF, CLOTHING HIMSELF, FEEDING HIMSELF AND GETTING HIMSELF ON THE SCHOOL BUS. ALSO THIS CHILD HAS HAS SOME SEXUAL ISSUES WITHIN CMS AS TO THE CMPD HAD TO INTERVENE. THE SCHOOL STAFF SUSPECTED PHYSICAL ABUSE BUT COULD NOT PROVE. THIS CHILD IS IN THE 4TH GRADE AND HAS NEVER PASSED A EOG TEST AND PROVEN NOT TO BE ABLE TO READ AT GRADE LEVEL. I AM INFORMED THE CHILD REMAINS IN HIS NEGLECTFUL ENVIRONMENT. HOW?-HOW DOES THIS HAPPEN? HAVING ALL THESE ENTITIES INVOLVED?

  3. I have been involved with the system, and my children have fallen through the system. My ex-husband is a long-term addict/alcoholic and I had a restraining order for 1 year against him due to spousal abuse and a threat to kill me.

He was able to circumvent the court system, even though there have been numerous incidents of violence with the children.

    • I can relate to every tragic story of this broadcast. My child has fallen through the cracks. Just stay encouraged “L”. Stay Prayed up. GOD loves his little children. Certain people take on positions to protect the children and intentionally fail to do so for whatever reasons. Just know in the END… The people with these positions have to be accountable to OUR HEAVENLY FATHER. I hope this guides you through your circumstances. Hopefully you will be able to give testimony on how GOD brought you through it all. As for your children, for now pray for them and I will too. (The WORD says “when two or three comes together in Jesus Name GOD will be in the mist of). Hope the right seed can be planted and rooted in them. No doubt as one of the speakers stated, these abused and neglected children will carry life long effects from these situations. I hope and pray my child doesn’t become a rapist or a menace to society as another stated. The odds are present. Thank you CFCR for creating the negative odds for my child, although you were and are in a position to turn my child’s life around for the best, giving him options and a chance of normalcy…Instead, I bet they have calculated a spot for my son in the future budget for the Jails. I’ll cast the Devil down in the Name of Jesus. I will fight…I will stand for the right things and will not compromise. GOD favors me. This was just another TESTimony.

  4. several community advocacy group leaders listened to portions of your show this morning with guest judge Bell, Paul Risk and Brett Loftis. It would have been benefitual if you would have invited an impartial speaker/or speakers whom do not have a vested interest in capatalizing on the financial gain, stemming from problems faced by our children and families within this community, once these three entities become involved in our lives.
What these guess had to say sounds great if things actually worked the way they described it, however the reality is this system is badly broker, and the communities experience is for the most part in complete contrast to what what said on your show.

  5. I am a local pediatrician who is very concerned about the current state of affairs in our family courts in Mecklenburg County- as well as what is occurring with the Department of Social Services. In one case of which I am aware, the child’s father had admittedly beaten a 3 year-old and left bruises that were visible for a week but no action was taken by DSS against the father. This child’s sibling (a few years later) tested positive for barbiturates (a sedative) when he returned from a visit at his father’s house. DSS was notified but never searched the father’s home and never investigated it. There is a MAJOR problem in this county– if the parents are divorced or getting a divorce then the protective parent (or the one that reported the abuse) is persecuted in court. In fact, in 75% of divorce cases that involve allegations of abuse, the protective parent (or the parent that reported the abuse) will lose custody. Many of the judges in Mecklenburg County have a prejudice against mothers who report suspicions of abuse. This case is just one of many examples that have occurred in this county. I have contacted Paul Risk regarding my concerns and he never returned any of my calls. There are laws to protect people from civil action for making reports to dss; however, the judges ignore these laws and take custody from mothers (occasionally fathers) for making said reports. The children’s safety is taking a backseat to the divorce issue.

    • I agree, the courts support Maternal Deprivation Abuse
Maternal Deprivation, or Motherlessness, because it is occurring with alarming frequency due to the unethical treatment of women and children in family court when they contact DSS as they are required by law to do. Women are warned and made to fear contacting DSS. Maternal Deprivation is inflicting abuse by severing the mother-child bond. It is a form of abuse that men inflict on both the mother and children, especially men who claim they are “parentally alienated” from their children when there are complaints of abusive treatment by the father.

Maternal Deprivation occurs when men seek to keep their children from being raised by their mothers who are the children’s natural caretakers. Some men murder the mothers of their own children. Others seek to sever the maternal bonds by making false allegations of fictitious psychological syndromes in a deliberate effort to change custody and/or keep the child from having contact with their mother when there are legal proceedings. DSS can not protect the children because unless they see the abuse, it is very hard for them to prove if the abuser denies doing the abuse. Wake up Mecklenburg County Judges!!

    • Counsel for Children Rights (CFCR), is unknowingly to the donators, Mecklenburg County’s nightmare. This is a NON-Profit(?) organization. 1. An Organization that is written in the Family Court’s local rules. 2. Quite a few Judges and Attorneys have served in some capacity with this organization (Conflict of interest for some of CFCR clients). Thus, the relationship between certain Judges included the Chief Justice gives CFCR power that is actually bigger than DSS. CFCR has no accountability protocol. No one to be accountable for destroying families. During that broadcast, I heard so many lies on behalf of CFCR. CFCR actually specialize in separating children from the protective parent, they waste taxpayers money with unnecessary Multiple recommendations sending the healthy parent through loops with evaluations. CFCR completely alienates that abused/neglected child from the healthy parent. I know of literally 10’s if families and children CFCR has destroyed. CFCR creates the same kind of children they claim to save. DSS has follow-up issues. DSS easily overlook the children. DSS do not investigate deep enough to see if a child is being neglected or abused. An Abuser can easily pull the wool over DSS eyes. The children that are slipping through the cracks now, will later become Charlotte’s Menace to society. You think you see crime now, wait to you see the new age crime that is coming. The problems with our children and community is NOT starting in criminal courts. The problems are hiding in the FAMILY courts.

  6. I also have a question for Bret Loftis. I know many mothers who cannot afford an attorney because they were a stay-at-home mother prior to divorce and no longer have the ability to pay for an attorney. Then their ex-husbands take them back to court to get custody. Many of these mothers have contacted the Council for Children’s Rights in order to obtain a volunteer or sliding-scale attorney. They were told that this is not what you do. Are there any resources in the community for a parent who cannot afford an attorney in order to protect their parental rights? Or is child custody for sale in Mecklenburg Countuy?

  7. There is a problem in every state. This is a list of cases over the last year or so where the system has failed including DSS. Judges ignore complaints of domestic violence from women and call it Parent Alienation Syndrome and give the child to the father if a women complains of domestic violence or gets DSS involved. This problem is overwhelming in North Carolina courts and in Mecklenburg County and is covered up in our state.

    • Thank you so much for providing this information. It is definitely an eye opener.

    • Update:
88 Killer Dads: Fathers who ended their children’s lives in situations involving child custody, visitation, and/or child support (USA)

An update of our 76 Killer Dads posting–previously published in February. Remember, this is not a comprehensive list of all U.S. fathers who have killed their children in situations involving domestic violence and/or child abuse. This is limited to articles I have found personally where there was an identifiable child custody, visitation, and/or child support angle in the children’s deaths.

    • I pray that you are not the custodial parent as your name would certainly be on the much longer list of murdering mothers, the only real solution is not divorce and is definitely not using your children as leverage against the other parent for money or anything else as they are the most precious and as ADULTS and PARENTS we must make our own sacrifices for their security and happiness not our own selfishness first.

  8. I am a child care provider. I am in constant contact with parents and other providers who provide care for children. The court system is fooling no one. I have never met a parent or provider who did not know about the corruption in the court system and their extreme abuse of children. Everyone knows about paternity fraud, making dads the dad who are not really the dad and forcing them to pay child support. Everyone in child care gets to meet the children who have been deprived of a loving parent due to the abuse of the court system. Everyone seems to know someone who had a child taken who was a loving parent and the court system took their child. Why? Money, it all boils down to MONEY! That is what the court system is all about. The judges, Guardian ad Litems, Council for Children’s Rights they are all about making money for themselves and destroying the family in the process. Most Guardian ad Litems are attorneys out for money and blood. Who do you people think you are fooling? Check out the internet. Talk to anyone who has gone through the court system. The only people who talk good about the court system are the ones making the money from abusing families and their children. It is the government that is abusing the children and everyone knows it. Check out the internet on abuse of children through family courts. Check out DSS corruption, corrupt judges, corrupt attorneys, corrupt Guardian ad Litems, families destroyed by the courts. I think change is coming soon. There are few people who are ignorant of what is really going on.

  9. Why was there no Guardian ad Litem present during this very important discussion?

  10. There are tons of abusive dads with children being forced to spend time with them based on patriarchal laws that make children into property – especially property of the father – women and children are being treated like dad owns them. Womena and children can pretty much forget about getting away from an abuser. It is a nightmare. The US has the NCMEC that is also acting like a mercenary hunting down women and children around the world like they are animals and forcefully taking the chldren from the moms. There is another woman from Brazil who has been ordered to turn over a 5 year old. These people are inflicting human rights violations on women and children. it is disgusting. The women and children of the US are going to have to plea for asylum from other countries if they want to get away. Also – the US is enganging in this torture of women and children by psychologists who for a price will accuse a battered mom or abused child of having the fake mental disorder of “Parental Alienation Syndrome”. Just like the runaway slaves who used to be accused of having “Drapetomania” for trying to escape from slavery, women and children are accused of this fake mental disorder – and the US courts are getting away with this charlatanism.

For an update of the Killer Dads see 88 Killer Dads.

There are so many every day it is shameful that the epidemic of rape, abuse and murder by men against women and children isn’t being made into a major issue. When will the US declare war on Intimate Terrorism?

  13. Where is bret Loftis the director of The Council for Childrens Rights i have been trying to speak with him for months now and he is never available?
I have a question Mr Loftis maybe you can blog the answer back to me?
Please direct me to the statutes, case law, the north carolina constitution prose, something somewhere that gives you the LEGAL RIGHT to have so called “guardian ad litems” custody advocates, volunteer attorneys, ( untrained and unqualified) etc taking over the parental rights of parents in family court.Parents whom are deemed fit, proper legal guardian of their OWN children? YOUR people are acting outside of the scope of their legal authority with total disregard for the rights of the parents whom find themselves in a situation where your “gals” have taken over their role and shut them out of their childrens lives. And for one reason and one reason only MONEY!!
to whom are you accountable as a non profit?? how are you allowed this kind of unchecked power in the courts as a non profit ??

  14. I dont see anything mentioned about how women abuse the DMV laws to turn A Custody battle in their favor. Or how in Civil Court the only evidence that is needed is her word against his. How if real evidence is presented by the Father that proves that the allegations are nothing more then the Plaintiffs inability to cope with the fact that one of the children want to live with their father, the Judge(PBM)ignores it.How Parental and Constitutional Rights are being taken away from Loving and Caring Fathers everyday in the courtrooms and nobody cares. How Domestic Violence programs define Being a Husband or Father as an act of Domestic Violence. If you retain any Chivalrous notions that a Father should take care of his family-You are Guilty of Domestic Violence,If you deny that you are Guilty- You are Guilty,If you point out that your spouse has done the things that she is accusing you of doing-You are Guilty. You are left with No Defense whatsoever and the judge(PBM) does not care.

How along with a single (True or False) accusation of Domestic Violence a Father has lost his right to fair and due process in court.
There is no free legal advice for you, There will be No Custody Mediation. The long term Emotional scarring this will have on your children which can lead to a plethora of personality disorders. Its crazy how Divorcing Parents are sent to a class by the courts to warn them of the pitfalls of messy custody battles. Yet the Court lets a parent do just what they had been told not to do and is rewarded with Custody of the children.
Domestic Violence in any form is Wrong,And so is Falsely accusing an innocent Father to win a Child Custody case !

  15. Parental Alienation Syndrome;
generally occurring due to divorce or separation, when a child expresses unjustified hatred or unreasonably strong dislike of one parent,These feelings may be influenced by negative comments by the other parent and by the characteristics, such as lack of empathy and warmth, of the rejected parent.

This occurs when one Parent puts down the other parent in an attempt to change the views of the child towards the other parent. It is a form of Brain Washing, ie If you tell a child that he/she has been to Disney World enough times the child will begin to develop a memory of having been there. Because the Child “Trust” the parent will tell them the truth.

This is done by, Access and Contact Blocking,Unfounded Abuse Allegations,And instilling Fear in the Children.

There is nothing Fake about it !

  16. http://dastardlydads.blogspot.com/2010/11/136-killer-dads-fathers-who-ended-their.html

An update. The carnage of fathers killing children in situations involving custody and visitation continues….

  17. Mr. Conklin: This column is not about addressing mothers and what they do wrong. Many of these mothers who’s children were murdered were victims of domestic violence and so were their children during the course of relationships with their abusers. I am here to tell you that often, once the victim leaves the relationship with her children, the abuser often can no longer directly target the victim except through her children. These men who are perpetrators of domestic violence, which are not kind and loving fathers, often re-target their victim through what she loves and cares for the most: her children. As you can see above, evidently these mothers tried to stand up and tell the court systems and those involved their stories of the abuse they suffered with their children at the hands of their abuser and no one would listen!! The end results are published above. So these women were NOT lying or making FALSE ALLEGATIONS, now were they?? Why is it when women who have been victimized by abuse, as well as their children, someone undoubtedly comes along to talk about how mothers alienate children from fathers, mothers who make false allegations, etc.??? Where does any of this have a place in this column????

  18. Ms Kay;
These Men/Women abusers certainly should be prosecuted and actions taken to stop any further violence. (I agree 100%) But Abuse of the laws by vengeful Mothers is also part of the reason some of these women fall through the cracks in the system. Doubt is cast on the Truth of their allegations because the Courts/Judges know how Attorneys use these false allegations to win cases.Believe me after having been confronted with these allegations I researched DMV fully and I was shocked at the numbers of innocent children murdered by their own parents,I spent many nights reading blogs and post by victimized women/men and was brought to tears on several occassions. But this abuse of the system is also DMV and as a Victim of this abuse I have suffered for 2 1/2 years through an emotional breakdown,Severe Depression, therapy, medications and now am told I have Social Anxiety Disorder because of this.In either case the Children are the true Victims and the Court System,Attorneys and Judges are to blame.

  19. Mr. Conklin: Now see? You did not seem to present the issue as equally distributed between mothers and fathers in regards to domestic violence until your final comment. But it is not only false accusations by mothers in the court systems about domestic violence that make it hard for us mothers trying to escape a abusive marriage with our children…and it is NOT just SOME of us that fall through the cracks There are many, many of us, as well as our children, who are abused by the father in the home and, when in court we try to tell of the abuse that took place, we are not believed or the incidents are minimized!! It is, by their own merit, the abuser’s ability to pull off the “father of the year facade” or put on their “nice guy” face because they are experts at this. They need to because this is their way of keeping their true self hidden to avoid discovery, and often they have been practicing this for years. This aids in discrediting their victim’s credibility. Often, us mothers in this predicament are forced to do shared parenting or co-parent with our abuser, so we have not truly escaped nor have our children. Many other abused women with children have lost custody altogether. Much of the time the abuse is documented also, and still judges and guardians ad-litem see fit to mandate shared parenting.

Why is it these same fathers who abused their children and mother, and were not much interested in their children during the course of the marriage suddenly want equal or full custody? Since their victim can no longer be directly targeted after a divorce, the best way to continue their victimization is through what she cares for the most: her children. This is achieved through threatening to gain custody, denial of access to children, denial of child support, turning the children against her, hurting or abusing children, or worse yet murdering them. On the flip side, if a child is hurt by an abusive father/husband while the mother is still married to him, and it goes to the family court systems, I have seen where the mother is accused of “failing to protect” her children by these same judges who award custody to abusive fathers upon a divorce. Now where is logical thinking and due process in all of this for us victims and our children??

Since you have fully researched Domestic Violence groups, then you must know that they do not define just being a husband and father ( especially a kind and loving one) as domestic violence. I have been involved with a few myself and I have not seen one mention that being a responsible husband or father denotes domestic violence! They are not in the business of saying anything like that. What alot of abusers do not like is that these agencies empower those of us who have been traumatized to escape a hellish nightmare with our children safely. But even then we face losing or sharing parenting with our abuser after a divorce-no matter how much we have endured prior.

No one is saying women do not abuse the court systems or make false allegations. No one here is saying all fathers do this, and mothers do not. Those of us who have been hurt, and there are many, many of us who have been brutalized along with our children, have been re-victimized by the family court systems all over again as mentioned above. We often do not lose custody or are forced to do shared parenting by a broken court system because we are accused of something we did not do, but because of disregard (or disbelief) of what was done TO us.
